Guest workers’ lawyer: Labor refuses to cooperate

Myers, the lawyer of nonresident guest workers seeking and administrative order settlement, said the Department of Labor doesn’t want to cooperate “despite my proactive efforts.”

Labor recently published its “overstayers” list for 2003-2007 that included some of Myers’ clients.

He said he already informed Labor that some of those on the list are his clients.

Myers said he also informed Labor about the law that entitles nonresident workers who have labor cases or court cases to be given a stay of deportation.

“If the case is with the court, they are also entitled to an order from the court directing the director of labor to issue a temporary work authorization pending resolution of their case,” he added.

Myers said he was told by Deputy Labor Secretary Cinta Kaipat that the department would not cooperate with him unless the court orders them to do so.

“What does this mean? That my clients, or others who have cases with Labor or in court who are not my clients, may be arrested and subject to the deportation order to show cause process,” he said.

He asked nonresident workers who are part of the lawsuit to get in touch with him.
