NMC Faculty Senate President Frank Sobolewski yesterday said the grievance was filed by a faculty member whose name he declined to disclose.
Today, Sobolewski said the complainant will meet with Fernandez to try to resolve the grievance.
The grievance, he added, was not referred to the NMC Employee Appeals Committee whose primary function is to hear and adjudicate cases presented by employees regarding suspensions, terminations and grievances.
Under the college’s administrative procedures, Sobolewski said the NMC president can address a grievance of an employee not related to suspension or termination.
According to the rules, should an employee is dissatisfied with the resolution reached through a consultation with his immediate supervisor, the employee may submit his grievance within five working days in writing to the president.
Soboleswki said if the employee is not satisfied with the efforts of the president, the employee with a grievance may inform the president and request in writing a review of the matter by the Employee Appeals Committee.
The committee is composed of two members of the college faculty or staff appointed by the president and three members of the board of regents appointed by the chairman of the board.
One alternate member may be appointed from the board by the chairman.
