Munson sentences man who lent his passport to illegal alien

Yin Ming Hao, a citizen of the People’s Republic of China appeared in court with his counsel Bruce Berline for the sentencing on Friday. The federal government was represented by Assistant U.S. Attorney Kirk Schuler.

The federal government moved for one year probation, with conditions of supervised release and deportation.

U.S. District Court for the NMI Chief Judge Alex R. Munson sentenced Yin Ming Hao to three years probation, based on the Sentencing Reform Act of 1984.

The defendant was also subjected to several conditions including his referral to the immigration office for deportation proceedings.

Munson said that if deportation does not occur and the defendant is released, he will immediately report to the U.S. Probation Office for supervision.

The defendant must not commit another federal, state or local crime, or unlawfully possess or use a controlled substance.

He will also submit to the collection of a DNA sample at the direction of the U.S. Probation Office, and comply with the conditions of supervision as adopted by the court.

He must not possess a firearm or other dangerous weapon and he will complete 100 hours of community service.

The federal court waived all fines since it has been determined the defendant does not have the ability to pay, except for a special assessment fee of $100.

The defendant was given 10 days to file any appeal to the sentence.

The defendant entered into a plea agreement and pled guilty to misuse of a passport.

The federal government stated that the defendant allowed Zhe Jun Jiang to use his passport.

Jiang has been charged for overstaying in the CNMI.

Authorities questioned Jiang on July 17, 2008 on suspicion of driving an illegal taxi.

 Jiang told police his name was Yin Ming Hao. He also surrendered Yin Ming Hao’s passport to  CNMI immigration officials.

 Jiang stipulated to deportation on Aug. 14 and was assisted by immigration officials to check in at the Francisco C. Ada/Saipan International Airport.

Jiang told the immigration officials that he needed to talk to a friend after checking in but he did not return. It was learned that he went to the parking area and handed the passport to Yin Ming Hao.

Yin Ming Hao then attempted to board the flight but immigration officials arrested him.
