Remengesau said Diaz made the false and defamatory remarks during the senator’s radio program on Oct. 20, 2008 which was later broadcast on MBTV.
Diaz claimed that “sources” told him Remengesau indicated there were public funds that could be used to pay Franny Reklai’s Construction Company to build a road to then-President Tommy Remengesau’s mansion in Choll, Ngaraard.Casmir Remengesau is the former president’s brother.Diaz, in his affidavit filed in court, denied that his remarks harmed Casmir Remengesau’s reputation and credibility.Diaz, through his lawyer Salvador Remoket, is requesting the court to dismiss the complaint, stating that Casmir Remengesau failed to state a claim upon which relief can be granted.Diaz said Casmir Remengesau also failed to take advantage of the equal time that the senator offered to him on his radio program.Diaz is also seeking relief, including cost of suit and attorney’s fees, against Casmir Remengesau, a former national planner.Casmir Remengesau was responsible for the implementation and coordination of medium-term fiscal and economic planning initiatives, including the development of performance-based budgeting system during his brother’s administration.Casmir Remengesau sued Diaz in November and, through his lawyer J. Uduch Sengebau Senior, is seeking damages and an order enjoining the senator from making any defamatory remarks.
