House Bill 8-14- 1 also included a provision which modifies one of the powers granted to the Special Prosecutor.
According to the present law, the SP is permitted to subpoena witnesses, administer oaths and obtain testimony either on the basis of the probable cause or after a complaint has been filed.The bill however changed the provision so that the SP will only be permitted to subpoena witnesses, administer oaths, and obtain testimony after a complaint has been filed.The floor amendment introduced by Del. Jonathan Isechal said that the change will “even the playing field.”Isechal added that the amendment is in line with the general rule regarding subpoenas. Isechal added that the change to the law will also result in greater efficiency by requiring a complaint to be first filed before issuing any subpoenas.The measure will provide guidelines and standards for the benefits of the states seeking to borrow money and to ensure fiscal stability of both the borrowing states of the national government.The bill added that the borrowing should be limited to a maximum of $5 million to each state government.
