The defendant has failed to register in the CNMI since his arrival in 2005.
The court ordered him to register as a sex offender with the Department of Public Safety prior to his release.
The court set his arraignment for Aug. 24 at 9 a.m.
Department of Public Safety spokesman Jason T. Tarkong said at 12:19 a.m. on Wednesday, Police Officer Joseph Magofna was dispatched to respond to a domestic violence incident at a residence on Bebetna St., Papago.
Tarkong said Magofna met the 42-year-old female victim who was crying as she showed her swollen right eye and abrasions to both hands.
The victim said she was attacked by her boyfriend, the defendant.
The victim and the defendant were playing at High Roller Poker near Shirley’s Garapan.
The defendant had given the victim money to play poker.
When they were finished playing, the defendant asked her for his money.
She gave him a few dollars which upset him.
The defendant claimed that the money the victim won belonged to him.
An argument ensued between the two inside the establishment and continued on when they were in the car parked outside the poker establishment.
Police learned that the defendant grabbed the money she gave him and attempted to stuff it into her mouth.
She defended herself by striking the defendant.
When the victim attempted to escape from the car, the defendant threw a full can of beer at the victim which narrowly missed her.
The victim asked for help from the security guards outside the Poker establishment.
Police learned that the couple left the area in the same car but the argument continued on their way home.
The victim said the defendant ordered her to get out of the house.
She said she packed her belongings when the defendant punched and kicked her several times.
The victim managed to escape and ran to the neighbor’s residence where she called 911.
Police officers who were conducting investigation observed the defendant driving by the neighbor’s house.
They arrested the defendant and transported him to the Department of Corrections.
Tarkong said Tudela was convicted by a jury in Carson City, Nevada on Jan. 4, 1989.
He was sentenced to life in prison for burglary, battery with use of a deadly weapon, and sexual assault with a deadly weapon.
The defendant was registered as a tier two sex offender on Aug. 25, 2004 at the High Desert State Prison in Nevada and paroled shortly there after.
During his parole he registered with the Las Vegas Metropolitan Police Departments Sex Offender Registry Unit as Offender # 390971.
Tarkong said that shortly there after in 2004 he was listed in “non compliant status” by the Nevada Sex Offender Registry.
Tarkong said on Sept. 26, 2005, the State of Nevada Parole Board issued a warrant for Tudela’s arrest.
Tarkong said further investigation in this matter could result in additional charges against the defendant for other crimes such as failure to register as a convicted sex offender either before the local or federal authorities.
“Our records show that there are several noncompliant sex offenders who have failed to register and or update their registry,” Tarkong said.
DPS is notifying all convicted sex offenders to call 664-9026 or 664-9026 and ask for Tarkong.
