Case against PSB manager also dismissed

Associate Justice Lourdes Materne had dismissed the four counts of cheating, nine counts of money laundering and two counts of obstruction of justice filed against PSB former manager Emory Mesubed.

The information against Mesubed was dismissed without prejudice on April 28, 2008 after the Attorney General’s Office filed a motion to dismiss the case.The government’s ground for dismissing the case is that they intend to issue superseding criminal charges against Mesubed.Mesubed was charged for obtaining loans at PSB in the names of his two personal employees.Aside from Mesubed, PSB’s former president Mack Timothy Taunton and officers Deborah Rengiil, John Devivo and Margo Llecholch were also charged with 39 counts of criminal charges such as cheating, embezzlement, forgery, money laundering and conspiracy.The charges against Rengiil and Llecholch were dismissed with prejudice on October 3 while charges against DeVivo and Taunton were dismissed without prejudice.Independent Counsel Lewis K. Harley on October 2 submitted a motion to dismiss the information against the four defendants.Harley stated in his affidavit of dismissal that “ it is in the interest of public and good faith and for the purpose of the fair administration of justice” that the case be dismissed against defendants.Harley also stated that Taunton couldn’t be located at this time after he left his residence in Arizona on or about June 18, 2008.Chief Justice Arthur Ngiraklsong granted the motion and dismissed the case with prejudice against Rengiil and Llecholch and without prejudice against Taunton and DeVivo.The trial for defendants was supposed to start in October 28.
