THE civil trial for Tang’s Corporation lawsuit against Imperial Pacific International LLC will begin on Dec. 5, 2022 at 10 a.m. in federal court.
Tang’s Corporation has sued IPI over allegations of breach of construction contract agreement and consulting services, and is demanding $331,023.52 in damages.
At a hearing on Nov. 17, Tang’s Corp. attorney Mark Scoggins informed the court that his client was still in settlement discussions with IPI.
He requested that the proposed deadlines “be continued to allow continued settlements discussion.”
IPI, represented by attorney Samuel Salyer, joined Scoggins’ request.
Judge Manglona granted the continuance of deadlines by one week but added that the bench trial will still begin on Dec. 5.
Scoggins also told the court that Chinese and Tagalog interpreters are needed.
The judge granted the request for interpreters and ordered that the proposed findings of facts and conclusions of law be filed no later than Dec. 5.
As for IPI, Salyer said it intends to call witnesses via videoconference.
According to the lawsuit, Tang’s Corp. and IPI entered into an agreement in 2016 for the removal of construction debris from the casino resort construction site and storing it for disposal at IPI’s expense.
Tang’s said IPI failed to pay the amounts owed under the agreement totaling $144,623.52.
IPI, for its part, asked the federal to dismiss the lawsuit with prejudice, saying that the allegations are “imprecise, uninformative, and conclusory.”
