HAGÅTÑA (The Guam Daily Post) — A woman was allegedly punched, strangled and hit in the head with a dustpan by a man who had been sexually assaulting her.
About 7:15 a.m. Oct. 2, officers with the Guam Police Department received reports from a 23-year-old woman who accused Kini Tosima, 40, of assaulting her, according to a magistrate’s complaint filed Thursday in the Superior Court of Guam.
Earlier in the day, the woman was sleeping when she was awoken by Tosima, who was sexually assaulting her, according to the magistrate’s complaint.
In response, the woman kicked Tosima, who was leaning over her when she woke up.
“When the victim asked what he was doing, the defendant gave her a ‘smirk’ and walked out (of) the room,” according to the complaint, which added that the woman then began to throw items around the room, telling other people in the Dededo residence what had happened.
Tosima then told the woman to stop “or else he would beat her up,” but the woman refused and continued to slam items on the ground.
“The defendant then walked up to the victim and punched her face with a closed fist. A struggle then ensued, and the defendant swung her around the room,” before allegedly choking the woman with his right forearm and elbow against her neck.
The struggle stopped when a household member intervened and separated the two, which led Tosima to leave the room.
However, while the woman was waiting outside the residence and called for assistance, Tosima “took a dustpan and struck her head with the plastic portion, causing the dustpan to break,” the complaint stated.
Police observed that the woman had multiple scratches and lacerations to her hand, arm and upper lip.
When an officer spoke with Tosima, he allegedly admitted to sexually assaulting the woman while she was sleeping for about two seconds and then she woke up.
“The defendant admitted to punching the victim and also placing his right elbow on her neck and that he heard her making ‘choking noises’ during that time,” the complaint stated.
Tosima was charged with strangulation and family violence as third-degree felonies and fourth-degree criminal sexual conduct as a misdemeanor.
