Couple’s lawsuit against USCIS dismissed with prejudice

CHIEF Judge Ramona V. Manglona of the District Court for the NMI has dismissed the civil complaint of James and Simei Eagan against U.S. Citizenship Immigration Services after the parties filed a stipulation to dismiss the case with prejudice. With prejudice means it cannot be filed again.

The couple sued USCIS for not processing or not making any decision on their “green card” or U.S. permanent residency applications.

The parties did not provide any reason for the dismissal.

In her order on March 2, the judge stated that because the stipulation is signed by all parties and clearly indicates dismissal with prejudice, this case is accordingly dismissed with prejudice.

She directed the clerk to close the case.

The plaintiffs earlier asked the federal court to issue an order compelling USCIS to take action on their “green card” applications.
