Superior Court Associate Judge Joseph N. Camacho imposed a $5,000 cash bail on Untalan who was represented by Assistant Public Defender Emily Thompson at the bail hearing on Wednesday. Assistant Attorney General Chester Hinds appeared for the government.
Judge Camacho remanded Untalan to the custody of the Department of Corrections and ordered the defendant to return to court on Jan. 6 at 9 a.m. for preliminary hearing and on Jan. 12 at a.m. for arraignment.
In his bail order, the judge said if Untalan posted bail he will be allowed to travel back to Tinian, but must surrender his travel documents.
On Dec. 28, at 9:55 p.m., the complainant called Tinian Department of Public Safety and asked for police assistance.
She said her ex-boyfriend had been harassing her through text messages for days, adding that she was scared of what he might do.
On Dec. 29 at 7:35 a.m. the complainant called Tinian DPS again, saying that Untalan was outside her house.
When police arrived at the residence, the officers found Untalan parked in the middle of the road and shouting at the complainant’s house, “Tell him to come out, I’m waiting for you.”
Police advised Untalan to stay away from the residence, but he told them, “If you’re going to arrest me you need to call the whole SWAT team to take me down.”
A few minutes later, police were again dispatched to the residence of the complainant who called to say that Untalan was back.
Upon arrival, police officers saw Untalan exit his vehicle and ran toward the residence shouting.
He went to back to the back of the residence and started banging and punching the windows.
When he saw the approaching police officers he entered his vehicle and started to leave the area, but he stopped his vehicle when he saw his ex-girlfriend and a man coming out of the residence.
Untalan shouted, “I’m going to kill you” at the man as the defendant charged toward the residence.
Police tried to apprehend Untalan, but he ignored the officers’ instructions and was arrested.
Untalan’s ex-girlfriend told police that after they broke up four months ago, he had been harassing her periodically.
She said she did not report the previous incidents to the police, but the harassment had gotten worse when she started seeing another man.
