House panel subpoenas DPS chief

THE House Judiciary and Governmental Operations Committee on Wednesday issued a subpoena to Department of Public Safety Commissioner Robert A. Guerrero.

The hearing for his testimony was set for Dec. 7, at 10:30 a.m. in the House chamber.

The committee will ask him questions about DPS boating safety policies, procedures and operations, as well as records, expenses, travel authorizations, travel vouchers, reimbursement requests, boat manifests, float plans pertaining to the boat trips of Gov. Ralph DLG Torres, first lady Diann Torres, or their relatives and friends.

These include boat trips taken by earlier witnesses: Police Officers Emery Kaipat, Adrian Mendiola, Jomalyn Gelacio, Flora Aguon and Joey Dela Cruz.

The committee chair, Rep. Celina R. Babauta, said the line of questioning will include expenses related to fuel, food, beverages, water, materials, supplies, equipment, employee compensation including overtime, and any fuel fleet card purchases, purchase orders, contracts, rental agreements, boat charters, billings, and repair receipts from January 2015 to present.

The House panel will also ask Guerrero about any non-disclosure agreements signed between any DPS personnel and the Office of the Governor including but not limited to written and electronic communications like emails and text messages.

“You are further commanded to testify then and there under oath, give lawful and truthful responses to all lawful inquiries and questions put to you on behalf of the NMI Commonwealth Legislature, House of Representatives,” Babauta stated in the subpoena.

She said Guerrero may be accompanied by counsel of his choosing, but he must remain in attendance until excused by the committee members conducting the proceeding.

Failure to comply may subject the DPS commissioner to contempt, Babauta said.
