Italian construction firm and its principals sue IPI for breach of contract

MODICA Pro Limited, its principal, Corrado Modica, and project manager Glenn Patrick Bell, through attorney Joe McDoulett, have sued Imperial Pacific International LLC for breach of construction and employment contracts in the local court.

Modica Pro Ltd. is a construction firm hired by IPI “to complete the interior fit out” of level 14 of the Imperial Pacific Resort and Casino in Garapan, and the management of labor at the construction site.

According to the complaint, Corrado Modica and Glenn Patrick Bell entered into employment contracts with IPI to complement the construction contract between Modica Pro and IPI.

The original price of the construction contract was $2 million, the first $200,000 of which was to be paid upon the execution of the agreement, the lawsuit stated.

The lawsuit also stated that the contract provided for progress payments, and for payments for additional work performed for the benefit of IPI.

The plaintiffs “are entitled to damages totaling $2,600,000, plus interest, and attorney’s fees,” the lawsuit stated.

According to the lawsuit, the plaintiffs “endeavored in good faith to resolve this dispute prior to filing this complaint.”

But IPI refused to honor its obligations to the plaintiffs, the lawsuit stated, and as such they are seeking enforcement in the court.

The lawsuit was filed on March 4, 2022.

The beleaguered Saipan casino investor has also been sued by other former vendors and/or employees in local and federal courts.
