20-day jail term for man who punched nephew, cousin

Donald Kileleman, 40, a resident of As Lito appeared in court for the sentencing with his counsel, Assistant Public Defender Douglas Hartig. The government was represented by Assistant Attorney General Rebecca Warfield.

Associate Judge David A. Wiseman sentenced Kileleman to one year imprisonment each for two separate charges of assault and battery, all suspended except for 20 days and probation to serve two years on the two charges. The sentences will run concurrently with each other.

Kileleman will pay a fine of $200 for the two charges of assault and battery.

He was also sentenced to six months for disturbing the peace, all suspended and to run consecutive to his assault and battery sentences. He will pay an additional fine of $50 for criminal mischief charges.  

In addition, the court ordered him to stay away from the victims for the duration of his probation period. He must report to the Community Guidance Center for counseling and perform 75 hours of community work service.

He is to refrain from possession and consumption of alcohol beverages during his probation period, pay restitution to the victims for property damages and pay a $25 assessment fee.

Wiseman ordered Kileleman to report to the Department of Corrections on Jan. 5, 2009 at 8 a.m. and he will be released on Jan. 25, 2009 at 8 a.m.

Wiseman stated that it is his duty to consider the rights of victims and the gravity of the crime as well as its consequences.

He said he has to “consider the background and record of the defendant and give serious consideration to the goals of sentencing and assure the ends of justice.”

Kileleman was charged with two separate counts of assault and battery for punching his nephew and his cousin several times on Jan. 11, 2007.

He was also charged with one count of assault with a dangerous weapon for hitting his nephew with a flower vase; one count of criminal mischief for breaking the glassware of his nephew; and one count of disturbing the peace.

Keleleman was found guilty of two counts of assault and battery, criminal mischief, and disturbing the peace on July 18, 2008.
