2nd suspect in Chalan Kanoa assault ordered to post $3K bail

Roland Martin, a resident of San Vicente, will be subjected  to the following conditions if he posts bail:

• He is not to leave Saipan, Tinian or Rota without court permission and  he must surrender his travel documents.

• He is to keep a 7 p.m.-6 a.m. curfew and have no direct or indirect contact with the victim and his co-defendant.

 • The Department of Public Safety will be allowed to conduct random checks to monitor if the defendant is in compliance with the curfew regulation.

Martin was also ordered to provide the court with a sketch of his residence’s location.

On Oct. 3, Associate Judge Perry Inos imposed a $300 cash bail and a $2,700 unsecured bail on Martin’s co-defendant, Martino M. Omelau.

Govendo set Martin’s arraignment for Oct. 20 at 9 a.m., and the preliminary hearing for Oct. 14 at 9 a.m.

Martin and Omelau were charged with assaulting Emanuel Pamintuan at Chalan Kanoa, along Texas Road on Oct. 2, 2008.

Detective Joaquin Deleon Guerrero, in his affidavit, stated that the victim had just arrived home when another car pulled  into his driveway.

The two defendants asked the victim to leave but Pamintuan told them they had to leave as he was on his property.

Omelau then dialed 911 on his cellular phone and handed it to the victim, who spoke to the person on the other line.

Pamintuan reported the presence of the two defendants on his property.

He said that the next thing he knew, the two defendants were hitting his head and face several times.

He sustained a cut on his nose and a bruise on his face. His forehead and right temple was also swollen.

Martin’s co-defendant earlier said the fight started the night before while they were drinking in San Vicente.

The defendants said they followed a car they noticed outside their house and confronted the driver.

Omelau said the victim hit him in the face first and that triggered a fight between them.
