As part of a bail modification order, Judge Govendo on Thursday granted Manex Nimwes’ request to be released to his mother as third-party custodian.
The judge also imposed a curfew on Nimwes from 6 p.m. to 6 a.m.
Nimwes must have no contact with his co-defendant, Dionicio Angui Jr. who was previously released to a third-party custodian.
The government, represented by Assistant Attorney General Heather Barcinas, said Nimwes must also have no contact with friends when he is at home during curfew, and that DPS should conduct random checks at his house.
Judge Govendo agreed and granted the prosecutor’s request.
The court also modified the previously imposed $20,000 cash bail to $5,000.
So he can be released to his mother, Nimwes has to post $500 or 10% of the modified bail.
Nimwes and Angui were charged with burglary and theft.
According to DPS, on Sept. 12, police met with the owner of The Shack who showed officers a shattered window and surveillance footage of the suspects breaking into the establishment. The items reported missing included $350, about 30 pieces of black T-shirts with the establishment’s name printed on them, and an android cellphone.
Later that day, the owner managed to get a ping of the last location of the cellphone, which was Ellegh Avenue in San Jose. Police drove over to the area, but did not see any individual using a cellphone.
Nimwes and Angui were arrested after a routine patrol on Sept. 14, 2020 in San Jose.
While on patrol they noticed an individual exit the Friendly Market store and got into a vehicle wearing a T-shirt that matched the description from a recent case.
Police followed the vehicle to a San Jose motel where the operator exited the vehicle along with a female passenger. Both individuals were wearing the same print design T-shirts .
Police got down and interviewed the two who told them that Dionisio Angui Jr. had given them the shirts. Police were able to obtain a total of 11 black printed T-shirts and a cellphone that matched the description.
Following further investigation Nimwes and Angui were arrested in connection with the burglary and theft case.
