3 security guards sue employer for labor standard violations

Jessie Z. Vasquez, Nestor B. Dalo and Rogelio E. Gallega filed the complaint in federal court against Triple K. Corp. which is doing business as Global Security Agency.

The plaintiffs,  though their counsel Bruce Berline, is asking the court to grant them judgment against the defendant for unpaid regular time according to proof, for unpaid overtime pay, for an additional equal amount as liquidated damages, for damages, for pre-judgment interest, for costs of suit, for reasonable attorney’s fees and other relief the court deems proper.

Vasquez was hired as a security guard from Sept. 9, 2006 up to Sept. 11, 2009. Dalo was hired on Jan. 28, 2008 and worked until Jan. 23, 2009. Gallega was hired on Sept. 9, 2006 and continues to work for Global Security Agency.

The plaintiffs said they were assigned to various schools on Saipan and other places.

Based on the contract they signed, the plaintiffs were given a rate of $3.05 per hour, plus one and one half times on overtime above the 40 hours agreed per week, and only CNMI taxes and Social Security as deductions.

The plaintiffs said  they were required to pay for certain fees related to their yearly renewal of employment application, including permit processing, bonding and compensation insurance, physical examination and medical certification.

The plaintiffs claimed that the defendant did not properly compensate them for their regular time or overtime.

The plaintiffs  said they have been required to work in excess of 40 hours per week but the defendant paid them at a rate less than what was required by the Fair Labor Standards Act.

They said the defendant  made deductions from their pay that were beyond what was in the contact term.

The plaintiffs filed two causes of action against the defendant for failure to pay wages required under the Fair Labor Standards Act and for breach of contract.
