Yesterday, Superior Court Associate Judge Kenneth L. Govendo retained the $100,000 cash bail earlier imposed on Joseph.
Govendo also ordered the confiscation of Joseph’s travel documents.
Joseph is being held on charges of sexual assault in the first degree, sexual abuse of a minor, assault and battery, assault with a dangerous weapon, and disturbing the peace.
Govendo remanded Joseph to the custody of the Department of Corrections after the hearing.
Assistant Attorney General Shelli Neal represented the government while Assistant Public Defender Adam Miles was appointed as Joseph’s counsel.
In her affidavit, Detective Melissa Bauleong said she received an anonymous phone call on Nov. 12, 2010 from a woman who reported a sexual abuse of a minor case in Kagman III.
The victim’s mother “knows of the ongoing abuse but does not do anything about it,” Bauleong was told by the anonymous caller.
Bauleong contacted the Division of Youth Services and coordinated an interview with the victim at her school.
The victim said her stepfather started sexually abusing her when she was 10, and the recent sexual assault occurred on Nov. 10, Bauleong said.
The first sexual assault happened on the night her mother left their house to visit a sick relative at the Commonwealth Health Center, the victim told police.
Joseph woke up the victim, who was sleeping with her brothers inside their room, and told her to transfer to another room, where she was sexually assaulted, police said.
The victim said her stepfather was drunk every time he raped her.
Whenever she refused, she said her stepfather would threaten her with a knife, or have her do chores, like cleaning the house and even the restroom.
“Afterward, when [the victim] would lay down to rest, Joseph would come over and rape her again,” Bauleong said.
The victim said she was sexually assaulted over 10 times by her stepfather.
On Nov. 10, the victim said she arrived from school when her stepfather tried to rape her again, but she refused.
She said her stepfather ordered her to clean the whole house.
Later, while the victim was resting on the couch after cleaning the house, she said her stepfather raped her.
She said her stepfather told her that “should she report him to the police and he gets arrested, upon release from jail, he would come back and kill her.”
