AGO files petition for deportation vs man who damaged two cars

Assistant Attorney General Kathleen R. Busenkell stated in the petition that Li Xiwen is a deportable alien.

The respondent has been informed of his rights and has signed a stipulation to deportation and order.

On April 9, Superior Court associate Judge David A. Wiseman sentenced Li to 53 days imprisonment but gave him credit for 23 days he already served in jail.

Li was charged with Ying Xiang Cao with burglarizing two parked cars and stealing the cars’ battery and airbags on Sept. 26, 2008.

Li is scheduled to be released from the Department of Corrections on May 8 to the custody of CNMI Immigration for deportation, according to Wiseman.

Li was ordered to pay a $25 court assessment fee.

Li and his co-defendant were charged with theft, attempted theft, and two counts of criminal mischief.

Li entered into a plea agreement with the government, pleading guilty to two counts of criminal mischief.

 In exchange, the court dismissed the remaining charges against him.

Court documents showed that on Sept. 26, 2008, Li damaged the rear passenger side window of Rong Bai Li’s Toyota Corolla.

Based on the affidavit of  Detective Abraham C. Villagomez, the Department of Public Safety received a call reporting a burglary and theft incident at the former Joeten store in Chalan Kanoa on Sept. 26, 2008.

Li and his co-defendant were arrested by responding police officers.

Police said the two defendants, who were jobless, admitted breaking into the two vehicles and stealing airbags and a battery which they planned to sell.
