AGO wants to deport convict with expired entry permit

Assistant Attorney General Katie Busenkell said Si Yan Jie entered the CNMI on a nonresident workers entry permit status which expired on May 20, 2008.

But Border Management System showed that the defendant entered the CNMI on Sept. 4, 2008.

The government said  the respondent has failed to comply with the conditions of his entry, and is therefore a deportable alien under CNMI laws and regulations.

Based on the findings of Immigration Investigator Nicolas T. Reyes, the 50-year old respondent is a citizen of the People’s Republic of China who has been convicted of one count of felony on Sept. 28, 2007.

Si Yan Jie entered a plea to the offense of arson last year.

Associate Judge Kenneth L. Govendo sentenced him to12 months imprisonment last year, with credit for time which he served from Aug. 29, 2006 to Sept. 20, 2006.

Si Yan Jie was ordered to pay a $25 assessment fee, a $250 fine, and contribute to the payment of restitution to the victims.

He was also ordered to cooperate with the government in the prosecution of his co-defendant if requested.

Govendo set the review hearing for Sept. 10, 2009 at 9 a.m..
