Corrections officer voluntary surrenders

He has not paid his probation fee and fine for his disturbing the peace conviction in 2008.

Corrections Officer Jesse Reyes Babauta, 33, was escorted by fellow officers to his bail hearing in Superior Court on Friday afternoon.

Babauta, who was on duty at the time the bench warrant was served on him, appeared without counsel before Judge David A. Wiseman.

Babauta told the court he had no $1,000 cash for his bail which was imposed by Wiseman on June 11, 2009.

Assistant Attorney General Brian D. Gallagher is prosecuting the case.

Wiseman released Babauta on his own recognizance.

Babauta was ordered to return to court for his arraignment on Dec. 22, 2010.

On June 11, 2009, the matter came before Wiseman for a review hearing.

Gallagher and Assistant Probation Officer John Del Rosario were present but Babauta wasn’t.

“Based on the matter adduced and for good cause shown, [Babauta’s] probation revocation process is hereby implemented based on the declaration made by the Office of Adult Probation,” Wiseman stated.

In his petition, Del Rosario told Wiseman that Babauta had not paid $60 of his $100 probation fee.

Babauta also failed to pay a fine amounting to $1,050.

On Friday, it was learned that the probation officer assigned to the case was no longer working for the Adult Probation Office, and this was the reason why there was no action on Babauta’s probation.

Last August, Judge Kenneth L. Govendo dismissed without prejudice the criminal charges against Babauta filed by his wife.

The Attorney General’s Office moved to drop the case after the victim could not be found.

The AGO said Babauta slapped his wife in the presence of a child and threatened to kill her on Aug. 1, 2009.

In 2008, a jury found Babauta not guilty of assault with a dangerous weapon as well as assault and battery.

But Wiseman sentenced Babauta to six months for disturbing the peace, all suspended except for 30 days to be served under house arrest.

According to the AGO, Babauta assaulted a taxi operator with a .223 rifle at his house in As Teo on June 9, 2007.

The taxi operator dropped Babauta’s former girlfriend at his house prior to the incident, police said.
