Superior Court Associate Judge Kenneth L. Govendo also required Bautista, 44, to post a $500 cash bail, and the remaining $24,500 as unsecured appearance bond.
Bautista is only allowed to leave for work and to return home, the court said.
Govendo ordered Bautista not to have any contact with any of minor children at the residence where the defendant will be staying.
The Public Defender’s Office filed the motion on behalf of Bautista who has been incarcerated at the Department of Corrections facility in the past three months.
Bautista is to be released to his friends Josephine Aldan and Pascual Enriquez as third party custodians.
Bautista is being held on the charge of sexual abuse of a minor in the second degree, attempted sexual abuse of a minor in the first degree, and for driving without a license.
Assistant Attorney General Shelli Neal opposed the motion for bail modification, citing Bautista’s continuing danger to the community.
“Sex crimes are on the rise in the commonwealth and should be deterred,” Neal said in his motion to oppose bail modification.
Bautista’s release to a third party custodian “will negate any deterrent effect for others considering such egregious actions,” according to Neal.
Bautista sexually assaulted his 13-year-old victim who was living with the defendant in the same household, Neal said.
Without a valid operator’s license, she added, Bautista drove his victim to the Garapan Fishing Base.
The victim struggled with Bautista, Neal said.
At the time, Officer Jesse Wabol was making his regular check in the area when he discovered Bautista’s vehicle parked under a tree.
Wabol saw that Bautista was naked as the defendant jumped from the passenger side to the driver’s side of the car.
Upon his approach, Wabol discovered a young girl crying in the passenger seat, Neal said.
