Court finds probable cause in disturbing the peace case

Randy Dela Cruz appeared in court with Assistant Public Defender Douglas Hartig on July 7 for a preliminary hearing. The government was represented by Assistant Attorney General Rebecca Warfield.

After hearing the testimony, the court found that probable cause exists to charge the defendant for the crimes of assault with a dangerous weapon, disturbing the peace, and criminal mischief.

The court ordered the defendant to be remanded to the custody of the Department of Corrections.

Associate Judge David A. Wiseman set the arraignment for July 14 at 9 a.m. in the courtroom of Presiding Judge Robert C. Naraja.

During the bail hearing, Wiseman ordered Dela Cruz to post 10 percent or $1,500 of the recommended cash bail for his release.

The defendant was also ordered to surrender all his travel documents and not leave Saipan, and have no direct or indirect contact with the complainant and her minor children.

In an affidavit, Detective Vicente Babauta said  the Department of Public Safety received a report regarding a disturbance incident in Falugula,  San Jose on June 27, 2008.

Babauta said Dela Cruz was arrested by responding police officers andwas transported to the Department of Corrections where he was booked and detained.  

A woman said she was asleep with her two daughters,  four and six years old, when the defendant broke their door and started shouting at them.

The complainant said Dela Cruz was carrying a machete and was holding it over his head while asking them if they want to be killed.  

Another witness said he recognized the voice of the defendant asking him to come out and fight him.

The witness called the police.
