Court grants waiver of speedy trial in ‘ice’ case

Designated judge David A. Wiseman said the jury trial for Henry San Nicolas will start on Sept. 27, 2010.

“This waiver is in my best interest and that the ends of justice served by allowing this continuance of trial outweigh any other interest,” San Nicolas stated in his waiver.

His counsel is Joseph James Norita Camacho.

They told the court they needed more time to prepare for trial.

Assistant U.S. Attorney Eric O’Malley is prosecuting the case.

After posting $25,000 in unsecured bond, San Nicolas was released to his common-law partner and mother.

Previously with  the municipal dog control program, San Nicolas was assigned to an administrative position at the Tinian Public Library.

The U.S. Drug Enforcement Administration and the Tinian police arrested San Nicolas in May 19, 2010.

The grand jury indicted San Nicolas on the charge of distributing .12 gram of “ice” on July 17, 2009.
