Rodney Reyes Quitugua appeared in court for a bail hearing before Associate Judge David A. Wiseman with his counsel Steve Pixley. Assistant Attorney General Jeffery Warfield represented the government.
Wiseman, in his bail order, also required the defendant to report to court whenever required, obey all commonwealth and federal laws, keep all appointments with his lawyer, and observe a 6 a.m. to 6 p.m. daily curfew. Quitugua must likewise comply with any drug test request.
He waived the reading of information and advisement of his rights during the arraignment revocation hearing.
Wiseman set the next hearing for Nov. 17 at 1:30 p.m.
Detective Norman S. Rasiang of the Department of Public Safety Criminal Investigation Division filed an affidavit in court stating that Judge Kenneth Govendo signed and authorized an eavesdropping search warrant for the defendant on May 9, 2005.
On the same day, members of the Local Drugs and Firearms Task Force, with the assistance of the Drug Enforcement Agency, conducted a buy-bust operation of crystal methamphetamine or “ice” from the defendant using an undercover agent and a cooperating source.
The source was given $150 in marked money to purchase ice from the defendant. The affidavit stated that the defendant handed over a Ziploc bag containing white crystalline substance to the source.
Rasiang said the white crystalline substance was tested positive for the presence of “ice.”
