Court sets $25,000 cash bail in assault case

Superior Court Associate Judge Perry B. Inos told Borja to surrender his passport.

“The allegations against you are very serious,” the judge told Borja who was represented by Assistant Public Defender Richard Miller.

Assistant Attorney General William Downer, the prosecutor, told the court that Borja was still under probation for a theft case.

Inos set Borja’s arraignment for Nov. 9, while a preliminary hearing will be held on Nov. 5.

‘Ice’ case

A man who earlier pleaded guilty to two counts of “ice” trafficking on Saipan, waived his right to be charged by grand jury indictment and chose instead the filing of information against him in federal court.

Inos F. Germinaro, through his counsel Colin Thompson, signed the waiver that was accepted by U.S. District Court for the NMI Designated Judge David A. Wiseman on Oct. 30.

The two-page information signed by Assistant U.S. Attorney James J. Benedetto stated that Germinaro possessed .033 gram of methamphetamine with intent to distribute it on Aug. 12, 2008, and possessed .15 gram of “ice” with intent to distribute it on Aug. 26, 2008.

The sentencing range for Germinaro was between six to 12 months, and a fine between $2,000 to $20,000, his plea agreement stated.

Drug Enforcement Administration special agent Daniel G. Holcomb stated in his affidavit that between Aug. 2008 and July 2009, Germinaro, Julita A. Sablan, and Roque Norita “knowingly and willfully conspired and agreed together” to possess and distribute “ice.”

Sablan and Norita earlier pleaded not guilty to “ice” trafficking.

Germinaro, Sablan, and Norita were arrested last September.

Civil lawsuit

Two complaints were filed in Superior Court last week over unpaid debts. 

Seafix Inc. said Rick Parker  owed the company $4,683.02  for the equipment he rented and services the company rendered.

Parker has failed, refused, and neglected to pay the sum and continues not to do so, the complaint stated.

Seafix is seeking judgment over and against Parker for the principal sum of $4,683.02, for interest from Jan. 30 at the rate of 12 percent per annum, as well as attorney’s fees and court costs.

The other complaint was filed  by Triple J. Saipan  against Vicente G. Muna and Brenda Ann D. Muna.

The two entered into a credit sale contract with the firm for a motor vehicle and both are already in default, the complaint stated.

The company is seeking a judgment over and against the plaintiffs for the principal sum of $4,299.65, interest from May 20, at the rate of 10.5 percent per annum,  attorney’s fees and court costs.
