Court urged to continue status hearing for defendant in enticement of minor case

David Banes, who is Diaz’s court-appointed attorney, told the court he was still waiting to hear back from his DNA expert.

Banes is currently off-island, and is expected to return on Oct. 31.

He and Assistant U.S. Attorney Clyde Lemons Jr., who is prosecuting the case, have stipulated to continue the status hearing, which has been scheduled for Oct. 24, to a date convenient to the court after Oct. 31, 2011.

According to the indictment, between on or about Aug. 1, 2010 and Sept. 30, 2010, Diaz planed in from Guam to entice the victim “to engage in sexual activity” which is sexual abuse of a minor in the third degree under CNMI law.

Diaz, who has denied the charges, is currently detained at the CNMI Department of Corrections.
