Deleon Guerrero, Manglona found guilty of marijuana possession

Jurors also found Deleon Guerrero and Manglona guilty possession of marijuana on March 10, 2010.

Deleon Guerrero was not found guilty of possession and trafficking of “ice” on April 14, 2009, and March 8, 2010.

Jurors found Manglona not guilty of possession and trafficking of “ice” on March 9, 2010.

At about 3 p.m. yesterday, jurors informed Judge Ramona V. Manglona that they could not reach a unanimous decision “on one count.”

More than an hour later, the jurors reached a verdict.

After the verdict was announced, George Manglona’s counsel, Assistant Public Defender Douglas Hartig who temporarily appeared for Assistant Public Defender Michael Brown, waived the filing of a presentence investigation report, and moved for sentencing of his client.

Hartig asked the judge to reduce the $50 fine on George Manglona to $25, which Judge Manglona denied.

George Manglona was then discharged.

For his contempt of court case, Judge Manglona lowered his $1,000 cash bail to $300 cash with the remaining $700 to be posted as an unsecured property bond.

Judge Manglona at the same time denied the oral motions of Assistant Attorneys General Russel Lorfing and Shelli Neal to take in to custody Deleon Guerrero.

Government prosecutors  told the court that police found a firearm at Deleon Guerrero’s residence in connection with the arrest of his son, Ignacio Jr., last September for “ice” possession and trafficking.

Prosecutors said Deleon Guerrero Sr. had been convicted of a federal crime and thus was banned from possessing a firearm.

Prosecutors told the court that Deleon Guerrero Sr., a convicted felon, is a flight risk, as he is facing a possible mandatory imprisonment of 25 years.

The defendant is a danger to the community, the prosecutors added.

Judge Manglona then reversed her earlier ruling and ordered Deleon Guerrero Sr. to report to the Department of Corrections at 12 noon today.

His sentencing was set for March 30, 2011.

Prosecutors thanked jurors for their services while expressing disappointment with their verdict in the case against George Manglona.

“That’s how the system works. He went through the process with a fair and impartial jury,” Lorfing said.

“We believe we have taken out a danger in the community. It’s safer today than yesterday,” Lorfing said, referring to Deleon Guerrero’s verdict.

Joseph James Norita Camacho,  Deleon Guerrero’s lawyer,  thanked the jurors for finding his client not guilty of possession and trafficking of “ice.”

“It seems odd that Mr. Deleon Guerrero is found guilty while his co-defendant is not guilty of the same charge of conspiracy to commit trafficking of controlled substance. So who did Mr. Deleon Guerrero conspire with?” Camacho said.

The prosecutors said the court did not accept their amended information charging Deleon Guerrero with unlawfully removing a green sea turtle, and numerous trochus shells from Saipan waters, and unlawfully removing a fruit bat.
