THE CNMI Governor’s Council on Developmental Disabilities served for the second time a notice of termination to its executive director, Tom Camacho, claiming that the by-laws of the agency allow the majority vote to rule in case of personnel action.
Board Chairman Daniel Camacho told the executive director that his contract will end on June 29.
“Make preparations for your departure from the position of executive director and be ready to vacate the office by the effective date of June 29,” the chairman told the executive director.
“A request for personnel action for your termination will be prepared and processed as prescribed by the policies and procedures governing excepted service employment,” he added.
According to the chairman, under Article VIII, “Staff Section 1. Authority to Hire Council Director,” the Council has the authority to terminate the executive director.
On April 30, 11 of the 19 Council members voted in favor of terminating Camacho while 8 wanted him retained.
At that time, it was presumed that the “no” vote was carried because the “yes” votes did not meet the required two-third votes.
However, the chairman sought the legal opinion of the Attorney General’s Office on the issue.
Tom Camacho could not be reached by Variety. In an earlier interview, he said he might file a lawsuit if the Council would terminate him without due cause.
