AN employer has been permanently disqualified from hiring non-resident workers for violating labor rules, the Department of Labor and Immigration said.
In an administrative order, Hearing Officer Jerry Cody said Madan S. Hemlani of Lovi’s Emporium committed a breach of contract when he failed to give an employee in 2001 a written notice of the impending closure of his business.
“If respondent intended to close his business, he should have notified the department of the situation and arranged with the employee either to be officially repatriated or given transfer relief,” Cody said.
At the same time, Cody reaffirmed an earlier decision, handed down against Hemlani in Dec. 2000, involving another case, wherein he was fined and permanently barred from employing foreign workers.
