Michael A. O’Toole, through attorney Joshua Berger, is asking the Superior Court to award him relief against the Department of Corrections for damages in the principal amount of $11,562.10, for pre-judgment interest as allowed by law, reasonable attorney’s fees, and for costs and other relief the court deems proper.
O’Toole in his complaint stated that he was contracted by the CNMI government for perform consulting services on Saipan on July 15, 2005.
He said under the contract, he was to develop and occupational and staffing strategy for the development of the new CNMI prison and manage the department through the actual transition process.
He said in Nov. 2005, it was discovered that funds were insufficient to complete the capital projects necessary to open and operate the new facility.
He said the prospects of additional funds in the future were dim.
A contractual termination was entered between him and the then secretary of the Department of Corrections, Thomas A. Tebuteb, on Dec. 15, 2005. He said they agreed upon a termination fee of $22,461.10.
O’Toole said he got no payments until after eight months when he received a check amounting to only $10,899.
He said he has received no additional payments despite his numerous demands.
