U.S. District Court for the NMI Presiding Judge Alex R. Munson also denied the request of Wilbur Vic Masga Inos through his court-appointed counsel, Robert Torres, to be released to a third-party custodian with electronic monitoring.
Munson remanded the defendant to the custody of the U.S. Marshal Service.
Assistant U.S. Attorney James Benedetto represented the federal government.
In a two-page report, U.S. Probation Officer Margarita DLG. Wonenberg said “the court found no conditions of release appropriate at this time and detained the defendant until further notice.”
Investigation showed that Torres submitted the name of the defendant’s stepmother and the defendant’s brother as third-party custodian. Both were interviewed and understood the responsibility of a third-party custodian.
The defendant is on release pending a jury trial in the Superior Court where his step-mother was appointed third-party custodian.
The report stated that with the defendant’s brother presenting himself as an alternate and temporary third-party custodian, such an arrangement may be problematic basing on the defendant’s brother’s report that he can serve only as part time custodian.
The court set the jury trial for Inos for Feb. 17, 2009. He entered a not guilty plea during his arraignment on Friday.
All pre-trial motions should be filed by Jan. 5, 2009.
The defendant was indicted for one count of Hobbs Act Robbery and one count for use of firearm in the commission of a crime of violence. The indictment stated that Inos committed robbery at Rota Poker in Songsong on Aug. 4, 2008.
