U.S. District Court for the NMI Chief Judge Alex R. Munson said Guang Jing Chen’s sentence for the three counts of ice distribution will be served concurrently, with credit for the time served.
He will be placed on supervised release for three years for each of the three charges, to be served concurrently.
The defendant appeared for the sentencing yesterday with his counsel, Anthony Long, who argued for a downward departure under the advising guidelines. But the court denied the motion.
The prosecution, represented by Assistant United States Attorney Beverly McCallum, moved for the low-end range of 37 months jail term.
The court ordered the defendant to obey all laws and undergo a drug test after 15 days of release, and have two periodic drug tests after.
He was also prohibited from having firearms, and must submit himself to a collection of DNA sample.
He will render 100 hours of community work service and will participate in educational and vocational programs. After serving his sentence, the federal court ordered the defendant to be delivered to an immigration officer for deportation proceedings.
The court waived all fines, except for a $300 assessment fee which must be paid immediately after the sentencing.
The defendant has 10 days to file an appeal.
He was remanded to the custody of the U.S. Marshal Service after the hearing.
The court also ordered the U.S. Marshal Service to assess the defendant for any health problems.
The defendant was charged with three separate counts for distribution of a controlled substance. He was indicted for distributing 0.9 grams of ice on Aug. 15, 2007; 1.7 grams of on Aug. 17, and 4.5 grams on Sept. 14, 2007.
He entered into a plea agreement on Aug. 27, 2008.
