Federal court to hear NMC lawsuits in April

Guam District Judge Frances Tydingco Gatewood, who presided over Monday’s case management hearing, said there will be a final pretrial conference on April 11, 2011.

“Each party shall be required to attend [the status and settlement conference on Nov. 22, 2010] either personally or through a representative with full authority to participate in settlement negotiations and to effect a complete compromise of the case,” Gatewood stated in her written order.

Filing of discovery motions, experts’ disclosure for both parties, among other things, will start in December, and expert discovery must be completed by Jan. 3, 2011.

Fernandez, through her counsel Brien Sers Nicholas, is asking over $300,000 in damages for the termination of her employment contract. The amount does not include attorney’s fees and costs as well as punitive damages.

The NMC regents, through attorney Michael Dotts, are asking $50,000 in damages against Fernandez.
