Feds want businessman to comply with subpoena

The FTC has asked the  U.S. District Court for the NMI to compel Van Der Maas’ compliance.

“By failing to respond to the subpoena or provide any adequate excuse for doing so, Van Der Maas is in violation of an order of this court,” the FTC said.

It said its “counsel has attempted in good faith for several weeks to secure the compliance of…Van Der Maas.”

Although some of the requested documents are “readily available via the Internet,” Van Der Maas “has not produced these or any other documents responsive to the subpoena, and has otherwise failed to comply with the subpoena,” the FTC said.

On May 24, 2010, the FTC filed a complaint for permanent injunction and other equitable relief in the U.S. District Court for the Northern District of Illinois against Asia Pacific Telecom Inc., Repo B.V., SBN Peripheral Inc., John Hendrik Smit Duyzentkunst, and Janneke Bakker-Smit Duyzentkunst.

On June 16, 2010, a subpoena was issued on Van Der Maas to produce documents, information, or objects or to permit inspection of premises.

Attorneys for the FTC, Steven Werkinoff and James Davis, and Assistant U.S. Attorney Jessica Cruz for the Districts of Guam and the NMI said the subpoena is related to Asia Pacific Telecom Inc., a defendant in the underlying action.

The complaint stated that the defendants sell a telemarketing service that delivers prerecorded voice messages through telephone calls.

In the course of telemarketing, the complaint said the defendants made false and misleading statements to induce consumers to purchase products and service.

The defendants engaged in various deceptive and abusive telemarketing practices, it added.
