Govendo imposes suspended jail sentence on man in document fraud

Govendo also placed the defendant, Raymond Dela Cruz De Luna, on one-year probation.

The defendant will pay a fine of $300, court assessment fee of $25 and probation fees which will be determined by the probation office.

He will render 100 hours community work service to be completed within six months of his conviction.

He must submit to interviews with the investigators of the Division of Immigration, the Division of Labor and the Attorney General’s Office and will testify as needed before any tribunal in the commonwealth.

He must give truthful testimony concerning the submission of documents to the CNMI Departments of Labor and Immigration starting on July 7, 2005 and continuing through Oct. 17, 2007.

The defendant must not process any labor or immigration related documents for any persons except for himself during the probation period, and he must obey all federal and CNMI laws.

The defendant, represented by his counsel George Hasselback, waived his rights and entered a guilty plea to the offense of document fraud.

The court granted the commonwealth’s request to dismiss the remaining charges against the defendant with prejudice.

On Nov. 8, 2007, the commonwealth filed an information against the defendant charging him with document fraud, a violation which is punishable by one year imprisonment and a maximum fine of $500, or both.

Documents showed that the defendant falsely made an employment contract with another individual to satisfy a labor or immigration requirement in Oct. 2006.
