Chief Justice Miguel S. Demapan will preside over the hearing on Dec. 17 at 10 a.m.
Demapan told Govendo that he is entitled to retain counsel.
Govendo, who has denied the allegations against him, earlier requested the Supreme Court to allow the media to cover the hearing.
Retired Guam Superior Court Judge Richard Benson earlier recommended that formal proceedings be filed against Govendo for his “adios, muchacho!” remark to a convicted stalker and wife beater during a hearing in 2007.
On Nov. 14, 2008, Judge Ramona V. Manglona sent Demapan a letter, saying she believed there was “a substantial likelihood” that Govendo “committed a violation” of the American Bar Association’s Model Code of Judicial Conduct.
Benson said Manglona “should have used better judgment and refrained from condemning” Govendo publicly.
“Because the controversy is public, so too should be its resolution.”
