Hocog admits involuntary manslaughter of guest worker

Superior Court Associate Judge Perry B. Inos accepted Hocog’s change of plea, and scheduled the sentencing for Dec. 16, 2010.

The 22-year-old Hocog was remanded to the custody of the Department of Corrections after the hearing.

Hocog has been in jail since his arrest days after fatally punching Larry Garcia Gonzales, 37, who died on March 4, 2010.

The court  imposed a $100,000 cash bail on Hocog.

His jail term will be between zero and five years, based on the statute, said Assistant Public Defender Richard Miller, who served as the defense counsel.

Hocog will also pay $14,075.37 in restitution, a $100 fine, and a $100 court assessment fee.

Assistant Attorney General Eli D. Golob prosecuted the case.

Inos earlier rejected the first plea agreement which proposed a sentence of five years, all suspended except for three years, for involuntary manslaughter. After serving two years in prison, Hocog would have been eligible for parole.

The plea agreement was later amended, with Hocog pleading guilty to involuntary manslaughter in exchange for a five-year sentence, all suspended except for three years, with credit for time already served in jail.

On March 1, Gonzales was attacked near Kagman High School by Hocog.

Police said Hocog punched the victim in the face, causing Gonzales to fall and hit his head on the concrete pavement.

Gonzales, who lost consciousness after the incident, died after being in a coma for four days at the Commonwealth Health Center.

Hocog earlier denied the charges of one count of voluntary manslaughter, one count of aggravated assault and battery, and assault and battery.

The charge of murder in the second degree was dismissed by the court.
