ICE agents take farmer in custody for removal proceedings

After Judge Dean D. Pregerson of the Central District of California rendered his sentence, agents of U.S. Immigration and Customs Enforcement took into their custody Bo Hu Li for removal proceedings.

Pregerson waived all fines since it was determined that Bo Hu Li does not have the ability to pay, but required the defendant to pay a $5 special assessment fee immediately after sentencing.

Bo Hu Li was indicted on two counts of reckless violation of the Federal Aviation Act, and willful violation of the Hazardous Material Law on Feb. 25, 2010.

He was arrested last October.

Court documents showed that Bo Hu Li arrived on Saipan in 1995 as a farmer.

Bo Hu Li pleaded guilty to one count of an information charging him with a Class C misdemeanor for knowingly distributing an unregistered pesticide, according to Assistant U.S. Attorney Kirk W. Schuler, who prosecuted the case.

The prosecution said Bo Hu Li “knowingly distributed an unregistered pesticide by shipping several pounds of Lannate” when he travelled from China to Saipan on board Shanghai Airlines on or about Feb. 17, 2009.

Bo Hu Li was represented by court-appointed defense attorney Joseph Horey.
