‘Ice’ convict gets 9 months for violating supervised release

Judge John Allen Houston of the Southern District of California ordered Abal to report to the U.S. Marshals Service on Monday.

Houston also ordered Abal’s sister to ensure the self-surrender of his brother to federal authorities.

Houston said while incarcerated, Abal will participate in substance abuse programs as well as other drug treatment programs approved by the Federal Bureau of Prisons.

After his release from prison, Abal will be placed on supervised release for 49 months.

Abal, who was sentenced in 2005 for conspiracy to distribute “ice,” will stay away from drug users and drug traffickers as part of his supervised release conditions.

He will be placed in a halfway house within the community where he is to serve time.

He will complete the residential drug treatment program within 120 days of his release from prison.

Abal’s court appointed attorney Robert T. Torres recommended nine months imprisonment for his client with proper drug treatment which was also the recommendation of Assistant U.S. Attorney Kirk Schuler, the prosecutor.

According to the U.S. Probation Office, on March 8, 2011, Abal tested presumptive for methamphetamine and amphetamine.
