Immigration law’s impact on IR’s and other nonresidents

The lunch meeting will be held at the Pacific Islands Club-Charley’s Cabaret on Thursday, May 26, from 11:30 a.m. to 1:30 p.m.

This presentation is open to the public and will be an invaluable opportunity for employers and employees to learn about the impact that the federalization of Immigration will have on non-residents in the CNMI, particularly those who are Immediate Relatives, or IR’s, of U.S. citizens or IR’s of lawful permanent residents, LPRs or greencard holders.  Since the U.S. Department of Homeland Security has yet to publish the rules and regulations for Contract Worker visas, many non-residents who are eligible for U.S. immigration status have been reluctant to apply.  However, beginning November 28, 2011, the U.S. Citizenship and Immigration Service and Immigration and Customs Enforcement will no longer honor entry permits and umbrella permits issued by the CNMI government.  Anyone who does not have a U.S.-issued immigration status on that date will be considered “out of status” and deportable.  Mailman and Kara have found that there is a lot of confusion and misunderstanding about the federalization law as it applies to certain classes of nonresidents.  For the most part, those people who have the ability to change their status but do not do so are likely to find that they will have to leave the CNMI come November of this year.

Mailman and Kara will help clear up the confusion by addressing critical topics and questions such as: 

1) Who is an IR?

2) Does my IR spouse need a U.S. visa?

3) If I’m in a common law marriage with a U.S. citizen, do I need a U.S. visa?

4) Do I have to apply for a U.S. visa for my kids if they are IRs?

5) What about surviving spouses of U.S. citizens?

6) Are there any provisions for victims of abuse, human trafficking or violent crimes?

7) What is the status of IRs of CNMI permanent residents and FAS citizens?

8) What should an IR do right now?
