Inos denies motion to lower bail in ‘ice’ case

Inos also found the proposed third party custodian for defendant Cunyan Ma, 39, unqualified.

The court directed the prosecution to release the passport of Ri Bao Hu, the proposed third party custodian, by Friday, if it is not necessary to hold.

Hu’s passport was among the seized items by authorities during an effect of a search warrant at his shared residence with the defendant,  his girlfriend.

Ma’s bail was set at $50,000 cash.

According to the prosecution, Ma illegally possessed and trafficked “ice” on April 21, 2011.

In his opposition to the defendant’s bail modification, Assistant Attorney General Peter Prestley told the court Ma is a flight risk because, if convicted, the defendant is facing a minimum penalty of 25 years imprisonment.

The defendant does not have any other known means of supporting herself “except through selling crystal methamphetamine which poses danger to the community,” Prestley noted.

The prosecution said police purchased $700 worth of “ice” from Ma during a controlled buy on April 21, 2011.

When the defendant was arrested, Prestley said more “ice” was found her person, as well as the money used in the controlled buy.

Her car was also searched, “and more crystal methamphetamine was found,” according to Prestley.

Assistant Public Defender Richard Miller, who is representing Ma, asked the court to reduce the cash bail to $30,000,  allow the defendant to post $3,000 cash and the remaining $27,000 as unsecured appearance bond, and to be released to her partner as her third party custodian.
