Isai Roby gets 20 days

Superior Court Judge Perry B. Inos imposed a sentence of one-year incarceration, all suspended, except for 20 days, with credit for time served for the charges assault and battery, criminal mischief, and disturbing the peace.

He was also sentenced  to one year imprisonment, all suspended, except for 10 days, with credit for time served for the charge of criminal mischief.

The sentences were served concurrently and Roby was placed on three years’ probation.

Assistant Attorney General Peter Prestley prosecuted the case, while attorney Thomas Clifford served as counsel for Roby.

Roby will pay jointly and severally the amount of $1,736.82 to the victims, and another $290 in restitution for the second case.

Roby will pay a $100 fine, court costs, and a probation fee.

He will complete 125 hours of community work service.

He will attend and complete anger management counseling; submit to an alcohol and drug assessment and complete the recommended treatment; will not possess or consume alcohol or controlled substances; and will subject himself to blood, breath, or urine tests.

On or about Jan. 1, 2011, Roby went to a beauty salon in San Jose, where he assaulted his victim who suffered facial cuts, swelling and bleeding. The incident also damaged property in the salon.

“[He] disturbed the peace of all present,” according to the plea agreement signed by Roby.

On or about May 4, 2010, police said Roby kicked the victim’s pick-up truck that caused a dent on the rear of its passenger door.
