After a day of bench trial, Govendo granted the motion of Assistant Public Defender Douglas Hartig, Lin’s counsel, for a judgment of acquittal.
Hartig said the prosecution failed to prove the elements of the crime as alleged in the information filed in court.
The information did not state facts sufficient to constitute an offense, Hartig added.
Assistant Attorney General Nicole Driscoll, who prosecuted the case, told Variety the victim/witness recanted her previous statement to police.
