Judge dismisses deportation proceedings vs woman

Associate Judge David A. Wiseman granted the motion to dismiss the “deportation matters” against Dolores de Guzman during yesterday’s hearing.

On May 6, the Attorney General’s Office and the Division of Immigration Services through Assistant Attorney General Kevin A. Lynch and de Guzman filed a settlement agreement.

The agreement stipulated that de Guzman failed to comply with the requirements and conditions of her entry to the CNMI and overstayed as her long-term tourist entry permit expired on June 19, 2001.

She agreed to pay $700 in permit fees and $175 for alien registration fee within 90 days of the order dated May 6.

De Guzman was also ordered to submit an application for an Immediate Relative entry permit within 45 days and provide proof to the AG’s Office in 45 days.

Upon the respondent’s compliance with the order, the commonwealth will file with the court a dismissal of the petition to show cause.

Immigration investigator Abram C. Togawa filed an affidavit in Nov. 2006 declaring that de Guzman, a citizen of the Republic of the Philippines, was issued a long term tourist entry permit which expired in June 2001.

Togawa said de Guzman does not have any pending labor case or pending labor application for employment status, and does not have any temporary work authorization.

Togawa said as of Nov. 29, 2006 the respondent had overstayed in the CNMI for six years and five months.

Based on the information obtained from the Labor and Immigration Identification and Documentation System, de Guzman is a deportable alien, Togawa said.
