After hearing oral arguments from both parties, Associate Judge Perry B. Inos ruled that Yuhua Wang may be held accountable for committing the crime of trafficking of controlled substance, and illegal possession of controlled substance.
Assistant Attorney General Kathleen Busenkell also moved that one count of conspiracy, which the court also found to have probable cause, would be included in the amended complaint.
Bail
Wang was remanded to the custody of the Department of Corrections. The court set a $30,000 bail.
In the other two drug cases, Associate Judge Kenneth Govendo imposed a $50,000 bail on Frankie Tudela Mafnas, a.k.a. Kojack, and a $5,050 bail on Jesus Aldan Leon Guerrero.
Mafnas and Leon Guerrero were among the defendants arrested during the mass apprehension operations conducted by the Department of Public Safety’s Criminal Investigation Bureau on Friday.
Govendo remanded both defendants to the custody of the Department of Corrections.
Eavesdropping
Associate Judge Ramona Manglona authorized the eavesdropping on Wang as requested by Detective Sean White, a Customs officer.
A Department of Public Safety cooperating source on Feb. 25, 2010 told White and Detective Roque Camacho that Wang and another target were dealing “ice” in the Fina Sisu area, near Northern Marianas College.
The cooperating source said Wang and another man, also Chinese, were selling drugs at No. Wang College Store and PC Café in Fina Sisu, or in a parking lot of a hotel in Fina Sisu.
After securing an eavesdropping warrant, the police placed a controlled call on Wang on Feb. 27, 2010 through the cooperating source and arranged to buy “ice.”
Authorities were able to each purchase $200 worth of “ice” in the hotel’s parking lot and at No. Wang College Store and PC Café.
The next day, police executed a search warrant on No. Wang and recovered “ice” residue from a Ziplock bag found under Wang’s bed. Clear glass tube and a gram scale were also recovered, police said.
26 years smoking ‘ice’
Detective Dennis Masga Reyes said in his affidavit that Leon Guerrero was stopped by a police officer in Chalan Kanoa for a traffic violation on Feb. 23, 2010.
At the time, Leon Guerrero was not wearing a helmet and his scooter did not have a license plate, police said.
Leon Guerrero pulled away from the police officer and started running.
Police conducted a search on Leon Guerrero after his arrest.
Police said they found drug paraphernalia, a cigarette stick believed to be marijuana, and a small Ziplock bag containing white crystal like substance believed to be “ice.”
When brought to DPS Criminal Investigation Bureau’s office, Leon Guerrero told Detectives Castro and Norman Rasiang that he purchased “ice” worth $90 from a Filipino at the Welcome Laundry in Chalan Kanoa.
“Leon Guerrero also stated that he had been smoking ice for 26 years,” Castro said.
Sadog Tasi residence
On March 3, 2010, Judge Govendo approved an eavesdropping search warrant for Mafnas as requested by Detective Steven A. Castro.
A DPS cooperating source called Mafnas through telephone and arranged the drug deal at the defendant’s residence that yielded a Ziplock bag with “ice,” police said.
A second controlled buy was executed against Mafnas and authorities were able to purchase $100 worth of “ice.”
