Jury trial for sexual abuse case continues

Yesterday afternoon, when asked by Assistant Attorney General Shelli Neal, the prosecutor, about the incident, Philip Babauta, 27, testified he heard the minor telling her mother what had happened.

Babauta said he was about 12 feet from the mother and minor at the time.

When cross-examined by Assistant Public Defender Douglas Hartig, Babauta said the minor was living with her aunt, and not with him and her mother.

Babauta is the boyfriend of the minor’s mother.

Judge Kenneth L. Govendo asked Babauta, “Do you know when the minor is lying to you?”

“No,” Babauta replied.

He also testified that it was the aunt who texted the mother about what had happened to the minor in May 2010.

Assistant Public Defender Benjamin Petersburg also represents Babauta.

The prosecution said Iglesias, currently out on bail, sexually abused his victim, the minor. The defendant has denied the charge.
