Wiseman said the juvenile, who will turn 18 by the end of this month, will be transferred to the Department of Corrections facility in Susupe from the Juvenile Detention Center in Kagman.
But Wiseman said the juvenile will be separated from the adult inmates at Corrections.
Assistant Attorney General Brian D. Gallager, who is prosecuting the case, filed a brief, stating that the juvenile’s case should be treated as an adult case consistent with the Juvenile Justice Act of 2008.
The commission of murder or sexual assault by a juvenile will result in adult criminal proceedings, according to the Act, or Public Law 16-47, which took effect in Dec. 2009.
Yesterday’s preliminary hearing will continue today after the court-appointed defense attorney for the 31-year-old Joseph Cabrera Camacho Jr. cited a conflict of interest.
The 17-year-old juvenile; Camacho; Angel Jess Santos, 21; and Ivan Jones Castro, 33; are all being held on a $100,000 cash bail and are in the custody of Corrections on the charge of kidnapping and raping the 16-year-old victim.
