Quichocho earlier filed a complaint of breach of fiduciary duties, injunctive and declaratory relief against the Office of the Mayor of Tinian and Aguiguan, including former Mayor Jose San Nicolas and other members of the Tinian delegation, in connection with the $1 million loan with Marianas Public Land Trust and personnel action for some Tinian employees to civil service status.
San Nicolas and fellow respondents filed for Quichocho’s disqualification since the lawyer also represented the respondents in the same matter.
“Whether Quichocho took directions from the mayor as authorized, of from [Municipal] Chairman [Antonio] Borja as plaintiffs claim, is of no consequence to the fact that he undertook to represent the municipality in the matter of the MPLT loan and thereby engaged the confidences of defendants acting in their official capacities. Attorney Quichocho may not represent plaintiffs in their present action against defendants based on the same matter,” Associate Judge Ramona Manglona stated in her Jan. 28 order.
