Man gets 18 months for stealing typhoon shutters

Wiseman sentenced Daniel M. Delos Santos, 31, to five years imprisonment, all suspended except for 18 months without parole, with credit for eight days served at the Department of Corrections facility.

Delos Santos is expected to be released from prison on Nov. 30, 2012. He will be placed on five years’ supervised probation.

The court ordered Delos Santos to pay $30 in restitution for a broken lock, a $500 fine, a $100 court assessment fee, and a probation fee to be determined by the Adult Probation Office. He will complete 100 hours of community work.

Delos Santos will write a 45-word letter of apology, and will stay away and not  have any contact with his victim during his probationary period.

Wiseman ordered Delos Santos to testify truthfully, if called, in any commonwealth or federal court proceedings about this case.

As part of the plea agreement, the court dismissed the burglary charge against Delos Santos.

On Jan. 23, 2011, Delos Santos and Ronald R. Kaipat, 34, were arrested for stealing 30 pieces of aluminum typhoon shutters, police said.

Details regarding the status of Kaipat’s case were not immediately available.

Wiseman earlier rejected Delos Santos’ plea agreement, describing it as “unacceptable.”

It was Wiseman who issued the judgment and commitment order on Aug. 9, 2005 against Delos Santos for assault and battery.

The defendant violated the conditions of his three probationary sentences, the judge said.

According to Wiseman, Delos Santos only served a total of 75 days of the five-year suspended sentences running concurrently, and noted the defendant’s “continuous activity in committing numerous crimes and being convicted of several.”
